A fence is a reason to check a landed home’s boundary, not sufficient evidence of where the legal boundary lies. Before paying for a property on the assumption that a garden strip, driveway edge or side passage belongs to it, match the title and survey records to the physical site. Where the position matters, arrange a property boundary survey.

This check is particularly useful when an extension, replacement fence or disputed strip could change how you intend to use the home. A small apparent area can have a large practical effect on access or planned work. Identify the issue before promising a construction date or treating the space as yours.

Title entitlement and the line on the ground answer different questions

Section 36 of the Land Titles Act 1993 sets out the evidential effect of the specified authenticated folio and Registrar-issued records. It makes the relevant record conclusive evidence of the proprietor’s entitlement to the estate or interest described. That does not turn a seller’s sketch, marketing photograph or existing fence into a boundary survey.

Section 36(3) also addresses an interest expressed as subject to an instrument or provision: its contents are treated as set out in the folio. Ask the conveyancing lawyer to explain the actual title entries and referred documents. Reading only the address and registered proprietor can miss a restriction relevant to the intended use.

Our title, caveat and completion guide covers the wider conveyancing checks. A clear answer about ownership should sit beside an accurate answer about the land being purchased.

Identify which survey plan you have

SLA distinguishes several survey records. Certified Plans show final land-lot boundaries; Strata Certified Plans concern strata lots. A Registrar of Title plan shows provisional boundaries and is superseded by a Certified Plan after a ground survey. Cadastral maps show lot numbers and associated survey information for the selected area.

Record the plan type, unique reference and lot it concerns. A plan for another lot, an architectural layout or a broad neighbourhood map cannot simply be substituted for the relevant survey record. Ask the surveyor which current documents are needed to establish the position at this property.

SLA says these plans are available to the public through INLIS. Obtaining a document and interpreting its relationship to the ground are separate tasks. Keep the plan reference with the surveyor’s report so that later discussions concern the same evidence.

Check any entry concerning conclusiveness

Section 16 provides for folio entries concerning boundary conclusiveness for land alienated by the President and brought under the Act. Where the approved plan has inconclusive boundaries and dimensions, the entry shows that status and refers to the plan. The section also addresses the entry for conclusive boundaries and cancellation of the caution when the Chief Surveyor approves them as conclusive.

This provision has a defined scope. It does not mean every Singapore title has inconclusive boundaries, or that every boundary becomes conclusive merely because a fence has stood there. Have the actual folio and plan examined rather than assuming their status from the property’s age.

Use a practising registered surveyor for the boundary survey

SLA’s homeowner guidance says a property owner needs to engage a practising Registered Surveyor to carry out a property boundary survey. The surveyor then deals directly with SLA on the technical and administrative requirements.

For a proposed purchase, arrange the access, scope and timing with the seller and professionals before relying on an intended survey. Explain the specific concern: the side fence, a shared-looking driveway or an apparent mismatch with the plan. Ask what the survey will establish and which questions need separate legal or building advice.

Resolve the discrepancy before moving the fence

Illustrative situation: the marketing material depicts a lawn extending to an existing wall, but the buyer cannot reconcile that wall with the supplied plan. Keep photographs and obtain the relevant records and survey advice. Do not turn an uncertain line into a self-help fence move.

Even when the boundary is established, separate questions can remain about a claimed access right, an agreement with a neighbour or approval for proposed works. The survey does not by itself resolve every legal claim or authorise construction. Have the contract and any discrepancy addressed before committing to a use that depends on the disputed space.

Bring the title, plans, correspondence and proposed purchase documents together. Lin Xuan or Ade can introduce a property lawyer where advice is needed on the purchase or a boundary dispute. Coordinate the professional checks with the transaction timetable so that their answers can inform the decision.
