A tenant who remains after a tenancy has ended can face more than the former monthly rent. For the landlord, however, a claim for money and recovery of the home are separate questions. Establish the legal end of the tenancy, any agreed extension and the return of possession before treating the dispute as a simple unpaid-rent calculation.

This matters on both sides of a move. An owner may have promised the home to a new tenant, while the outgoing household may still be arranging accommodation. A short written agreement about extra time can reduce uncertainty; an informal conversation that leaves payment and handover unresolved can make it worse.

First establish whether the tenancy has ended

Start with the signed tenancy agreement and all later correspondence. Put contractual expiry, any early-termination notice, an agreed extension and the proposed handover date on separate lines. A proposed extension is not necessarily an accepted one, and moving belongings out is not the same record as returning possession.

The documents should explain who can remain, until when, on what payment basis and subject to which conditions. Keep the complete messages rather than selected screenshots. Both parties benefit from a shared handover appointment and a written record of keys, access devices and any remaining occupation.

Double rent is a financial risk, not an eviction order

Section 28(4) of the Civil Law Act 1909 provides for a landlord’s option of double rent until possession is given up, or double value during the detention, where a tenant holds over after the tenancy has been determined. The provision includes cases where notice of that charge has not been given. Whether it applies to a disputed arrangement still depends on the tenancy and facts.

That wording is a reason to resolve an extension before the old tenancy ends. It does not itself give a landlord a possession order or turn a disputed termination into an agreed one. Keep arrears, holding-over amounts, damage and any other alleged loss in separate schedules so the same sum is not casually counted twice.

Why the conditions of an extension matter

In Kwon Do Hyeong v Covenson Pte Ltd [2025] SGHC 212, the General Division of the High Court considered a concession on holding-over rent that depended on timely delivery of the property in the required condition. The court found the condition unmet and allowed the additional-rent claim: see paragraphs 41 to 45 of the grounds dated 30 October 2025.

The grounds record an appeal filed on 22 September 2025. A final appeal outcome has not been established here, so this is a High Court illustration of conditional correspondence, not a claim that the result is a final appellate ruling.

The practical lesson is to make the concession precise. Record the last day, payment basis, required condition and delivery of possession together. A phrase such as “one more month at the same rent” leaves important questions unanswered if the parties disagree about what was promised.

Separate settlement from the possession route

If the tenant remains and no settlement is reached, identify the appropriate legal route before taking action. Do not treat this guide as authority to change locks, remove belongings or disconnect services. The agreement, termination and remedy sought need to be considered together.

The Singapore Courts small-claims guide covers eligible residential tenancy agreements not exceeding two years and monetary limits. It does not mean every possession dispute belongs in the Small Claims Tribunals. Lawyers cannot represent parties in SCT proceedings. An introduction to a property lawyer can help clarify the appropriate route before a household commits to a disputed demand or settlement.

Make the handover and money position clear

Agree an inspection and key-return appointment. Record whether possession has been accepted and which financial issues remain disputed. A handover note need not say that all claims are settled unless that is what both parties have agreed.

For tenants, retain an accommodation budget rather than assuming the deposit pays for extra days. For landlords, avoid promising a replacement tenant a firm move-in date while possession remains uncertain. A negotiated handover can address dates and payment without pretending that every disagreement has disappeared.

Use our tenancy agreement guide for extension and exit clauses, and our tenant-rights guide for deposits and repairs. This is general information; the effect of a particular notice or settlement depends on its terms.
