A Singapore permanent resident is still a foreign person under the Residential Property Act. PR status does not provide blanket permission to buy a terrace house, bungalow or other restricted residential property. Sentosa Cove landed homes also require approval.

This guide explains the approval questions for individual buyers of Singapore homes. It separates property eligibility from stamp duty and financing. It does not assess a particular applicant, company, trust or developer. Updated 30 Sep 2026.

First identify the buyer under the right law

Section 2 of the Residential Property Act 1976 defines a foreign person by reference to specified Singapore categories. For an individual, the relevant category is Singapore citizenship, not permanent residence. The earlier version of this article wrongly excluded PRs from the foreign-person definition.

The Act also gives “Singapore company” a specific definition involving incorporation, directors and members, with further rules for corporate ownership chains. Incorporating a local company does not by itself settle its status. Do not assume a company owned by citizens and PRs escapes these requirements.

Section 3 restricts transfers and acquisitions except as the Act provides. Section 25 supplies the approval route for restricted residential property. The consequences are substantive: section 3(2) makes transactions in breach of the specified prohibitions void.

Check the property, not just the listing label

Examples from SLA’s current property-approval guidance
Property RPA approval position
Terrace, semi-detached or bungalow; vacant residential land Foreign person must seek approval.
Landed home at Sentosa Cove Approval is required.
Strata landed home outside an approved condominium development Approval is required.
Condominium unit or strata landed home within an approved condominium development Listed by SLA as purchasable without RPA approval.

Use SLA’s official guidance and have your lawyer verify the actual title and approved development status. “Cluster house” is not enough information to decide the answer. A mixed-use shophouse also needs its permitted use and relevant classification checked; its appearance cannot establish eligibility.

Absence of an RPA approval requirement does not mean every buyer can purchase an HDB flat or executive condominium. Those have separate eligibility restrictions. Ask HDB about the specific property and purchaser instead of treating the table as a universal permission list.

Understand discretion and conditions before committing

SLA assesses applications individually. Its published factors include at least five years of PR status and exceptional economic contribution. These are not a promise of approval. SLA says an in-principle application can be made before a specific property is identified; its estimated assessment period is about 30 working days after all required material is received, with possible extensions.

Under section 25(4), approval can be granted with conditions or refused. Section 25(5) addresses an individual applicant’s own and family occupation rather than rental use. Section 25(7) permits conditions covering occupation, restrictions on disposal for a specified period, security and undertakings. Read the actual written approval before building a letting or resale plan around the property.

For an investor, this can change the basic purchase decision: an approved home subject to an occupation condition cannot simply be treated as a freely lettable investment. For an occupier, check whether the intended household use fits the conditions. Ask your lawyer how those conditions interact with any later move overseas, change in circumstances or sale.

Agree what happens if approval is delayed or refused

Before paying for an option or signing a binding document, ask your conveyancer to explain the approval dependency, contractual deadlines and consequences for money already paid. Do not assume that an unsuccessful application automatically returns a deposit or extends an option. Those questions require the actual contract.

Ask for a written record of the property classification, applicant status, approval needed, application documents and outstanding information. Keep the authority’s decision and conditions with the purchase papers. A seller’s assurance or an agent’s estimate is not the approval itself.

Section 25(11) provides for a written decision. If approval is refused, section 25(12) allows representations to the Minister within three months of the notice, or a later period allowed in the particular case. Section 25(13) contains the finality provision. The old blanket statement that there was no route to challenge a refusal omitted the statutory representations process; obtain advice promptly on the decision received.

Calculate duty separately from permission

RPA approval does not waive BSD or ABSD. IRAS uses its own buyer profiles for ABSD: for example, the standard first-property rate for a PR is 5%, while the standard rate for a foreign individual is 60% from 27 April 2023. Applicable remissions and exemptions must be checked; these are not quotations for every applicant.

That distinction explains why a PR can be a foreign person for landed-property approval while having a different ABSD profile. For a joint purchase, IRAS generally applies the highest applicable buyer rate to the entire acquired value. Have the tax calculation and approval assessment recorded as separate conclusions.

Inheritance needs its own retention advice

Do not use the former article’s universal twelve-month disposal claim. Where section 3(4) applies, the personal representatives’ statutory sale period is five years from death, with the extension mechanism in the Act. This is not a blanket right for every foreign beneficiary to retain every home for five years: the property’s status, approvals and statutory exceptions matter. Section 3(13), for example, addresses a surviving joint tenant.

Ask the estate lawyer and SLA’s Land Dealings Approval Unit which route applies before agreeing to retain, transfer or sell. Our inheritance cost guide separately explains why an estate’s tax and CPF assumptions also need checking.

Legal sources checked 30 September 2026: current SSO text of the Residential Property Act, particularly sections 2, 3 and 25, plus the linked SLA and IRAS guidance. No new commencement change is asserted. No case citation is necessary for this statutory approval guide, and no lawyer review is claimed. Correction: removed false PR and Sentosa exemptions, misleading company and inheritance rules, inaccurate tax calculations, unsupported approval guarantees, project dates and market forecasts. Old charts were removed.
