A property estate plan needs the title, will, CPF nomination and mortgage arrangements to work together. Listing a home in a will does not answer every question about ownership, the surviving household’s cash or whether a beneficiary can retain it. Start with the documents you have, then test the intended result with your lawyer.
This is a planning checklist for Singapore property owners, not an allocation of a particular family’s inheritance. Cross-border assets, Muslim estates, trusts and disputed ownership need advice on their own facts. Updated 29 Sep 2026.
Start with how the home is held
CPF Board explains that a deceased owner’s interest held under joint tenancy passes to the surviving owner or owners, whereas a tenancy-in-common share forms part of the estate. A property bought using CPF is not itself covered by a CPF nomination.
Obtain the title record and ask your lawyer to explain what your intended gift can actually achieve. Do not assume the person paying most of the mortgage necessarily has the share you intend to leave. If you propose changing the manner of holding or ownership shares, obtain advice on consent, financing, duties and eligibility before taking action.
For a home occupied by a spouse, parent or adult child, describe the practical intention: continued occupation, sale, division of proceeds or another arrangement. Ask how that intention would work if another beneficiary needs money immediately. An informal expectation that “everyone will agree” is a weak basis for a housing plan.
Review the will and CPF nomination separately
Ask the lawyer whether your will is valid, current and consistent with the title, and where the original should be kept. Review it after marriage, divorce, a beneficiary’s death or a major property change; do not assume a family event automatically produces the distribution you want.
CPF nomination guidance states that CPF savings do not form the estate and cannot be distributed through a will. Marriage revokes an existing CPF nomination; divorce does not. Check the actual nomination record and make a fresh nomination where appropriate. Without a nomination, CPF savings go through the Public Trustee’s distribution process, with an administrative fee.
Put the expected recipients of the home and CPF savings side by side. Different recipients can be intentional, but test whether the person expected to maintain the home would have accessible funds. Do not assume a nominee must use a payout to meet someone else’s housing costs merely because that was discussed within the family.
Do not use a family-order diagram as a legal answer
Section 2 of the Intestate Succession Act 1967 excludes Muslim estates. Even where the Act applies, the relevant relationships and surviving family members matter. Ask a qualified practitioner to determine the applicable framework and shares. This checklist does not attempt a universal spouse-to-children-to-parents sequence.
If a flat or restricted property is involved, ask separately whether each intended recipient can retain it and what approvals or disposal obligations may arise. A gift in a will does not settle that eligibility question. Our property inheritance guide examines the ownership and next-purchase checks; our HDB documents guide addresses the records needed after an owner dies.
Check the next-purchase consequence, not just the transfer
IRAS distinguishes an assent under a will or the applicable inheritance rules from a later purchase: stamp duty is not payable on that qualifying assent, but inherited residential property counts when assessing a subsequent purchase. Do not extend that treatment automatically to a separate purchase of a sibling’s share or a different transfer arrangement.
For example, a Singapore citizen who retains an HDB flat and an inherited condo has two residential properties. Buying another is a third-property purchase, not a second. The current ordinary ABSD rate for a citizen’s third or subsequent purchase is 30%, under the rates effective from 27 April 2023, subject to applicable reliefs and the actual buyer profile. This example assumes both properties are still counted at purchase and no other co-buyer changes the applicable rate.
Prepare the surviving household’s cash plan
| Bring | Ask |
|---|---|
| Title and ownership records | Which interest can pass through the estate, and does that match the intended gift? |
| Will and CPF nomination record | Who receives each asset, and who is expected to meet ongoing home costs? |
| Mortgage and insurance schedules | What cover exists, what claim evidence is needed and what debt could remain? |
| Recurring home bills | Who can lawfully arrange payments while the estate is administered? |
| Existing LPA and contact list | Who may act during incapacity, and how can the right records be located? |
Do not put “mortgage cleared” in the plan without checking the policy, insured share and claim conditions. Obtain written information from the lender and insurer. Budget for recurring bills and administration without assuming immediate access to an estate account or a payout. The separate HPS and mortgage guide explains why an HPS claim is not an automatic promise to clear the whole loan.
Plan for incapacity as well as death
MSF describes an LPA as an appointment for decisions if the donor loses mental capacity, covering personal welfare and/or property and affairs. The powers granted matter. An LPA is not a substitute for a will or a blanket instruction permitting every property transaction.
Agree where documents and professional contacts can be found securely. Give trusted people a way to locate the records without sharing passwords, Singpass access or blank signed instructions. Revisit the plan when you buy, sell or refinance a home rather than treating it as a once-only exercise.
Correction, 29 Sep 2026: removed the incorrect 20% third-property ABSD example, unsupported inheritance tax-saving claims, automatic full HPS settlement, generalised divorce and foreign-beneficiary statements, fixed fees/timelines, speculative policy predictions and misleading diagrams. Current CPF, IRAS, MSF and statutory sources are linked above. This is editorially checked general information, not individual legal advice or lawyer approval.
